Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Vacationist mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

The App is operated as a personal side project by Gary Lude, based in Switzerland ("we", "us", or "the developer"). These Terms constitute the entire agreement between you and the developer regarding your use of the App.

2. Description of the Service

Vacationist is a collaborative trip-planning application that allows users to organise travel together. Features include activity suggestion and voting, shared expense tracking, real-time shopping lists, shared notes, accommodation and transfer management, and the secure storage of personal travel documents.

The App is provided free of charge. We reserve the right to introduce paid features in the future; any such changes will be communicated in advance.

3. Accounts and Registration

You may sign in using Google Sign-In or a magic link sent to your email address. You are responsible for maintaining the confidentiality of your account and for all activities that occur under it.

Guest accounts (created via invitation link without an email address) have limited functionality. You can upgrade a guest account to a full account at any time from the Profile screen. Guest accounts inactive for more than 90 days may be automatically deleted.

You must be at least 13 years old to use the App.

You retain ownership of any content you create within the App (trip details, activities, notes, expense records, etc.). By submitting content, you grant us a limited, non-exclusive licence to store and process that content solely for the purpose of providing the service to you and your trip members.

You are solely responsible for the accuracy and legality of the content you submit. We do not review or moderate user content.

6. Travel Documents

Travel documents (passport numbers, ID card details) stored in the App are encrypted and intended solely for your personal convenience. The App is not a certified identity-management system. Do not rely on the App as your sole record of travel document information. Always carry your physical documents when travelling.

When you grant another trip member temporary access to your travel document, you do so voluntarily and at your own risk. We are not responsible for how that information is used by the recipient.

7. Intellectual Property

All rights in the App — including but not limited to the design, software, trademarks, and graphics — are owned by or licensed to the developer. These Terms do not transfer any intellectual property rights to you. You may not copy, modify, distribute, or create derivative works of the App without express written permission.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the App is at your sole risk.

We make no warranties regarding the accuracy, reliability, or completeness of any information provided through the App, including expense calculations, travel document storage, or notifications.

9. Limitation of Liability

To the fullest extent permitted by applicable law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, travel disruption, financial loss, or similar — arising out of or related to your use of or inability to use the App.

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability is limited to the maximum extent permitted by law.

10. Service Availability and Changes

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We will make reasonable efforts to inform users of significant changes via in-app notification.

We do not guarantee any specific level of availability or uptime. Planned maintenance may result in temporary unavailability.

11. Termination

You may stop using the App and delete your account at any time from the Profile screen. Upon account deletion, your data will be permanently removed within 30 days in accordance with our Privacy Policy.

We reserve the right to suspend or terminate your access to the App without notice if we believe you have violated these Terms.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect any changes. For material changes, we will notify users via in-app notification at least 14 days before the changes take effect. Continued use of the App after the effective date constitutes acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to its conflict-of-law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Switzerland. If you are a consumer in the European Union, you may also benefit from mandatory consumer protection provisions of your country of residence.
